1. Who we are

The Site is operated by Samanga Utilities Limited, a company based in Kampala, Uganda, and a member of the Machapala Group. References to “Samanga”, “Samanga Utilities”, “we”, “us” or “our” mean Samanga Utilities Limited. Historical references to Samanga Solutions Limited refer to the same undertaking under its former name.

2. Informational purpose only

The Site describes our divisions, capabilities, projects and partners for general information. Nothing on the Site constitutes a binding offer, quotation, tender, warranty or professional advice. Any engagement for goods or services is governed only by a separate written contract, purchase order or formal proposal issued by us.

Project descriptions, photographs and figures may be illustrative or summarised. They do not create commitments beyond what is agreed in writing for a specific engagement.

3. Intellectual property

Unless otherwise stated, all content on the Site — including text, layout, design, graphics, photographs (including project, site and field imagery), logos, icons, downloadable materials and compilation of content — is owned by Samanga Utilities Limited or used under licence, and is protected by copyright and other intellectual property laws.

You may view and print pages from the Site for your own internal, non-commercial reference. You must not copy, download, scrape, republish, sell, rent, modify, distribute or commercially exploit Site content, images or branding without our prior written permission.

Trade names, logos and marks of Samanga Utilities (and historical Samanga Solutions branding) are our trademarks or trade dress. Partner and manufacturer names and logos (for example Motorola Solutions, Rohde & Schwarz and other suppliers named on the Site) remain the property of their respective owners and appear for identification of authorised or referenced relationships only.

4. Acceptable use

You agree not to misuse the Site. Without limitation, you must not: attempt unauthorised access to our systems or other users’ data; introduce malware; use automated means to harvest content or contact details; submit false or unlawful enquiry or chat messages; or use the Site in any way that is unlawful, harmful or infringes others’ rights.

We may suspend or restrict access to the Site where we reasonably believe these terms have been breached or where we need to protect the Site, our users or our business.

5. Third-party links and partners

The Site may link to third-party websites or refer to partners and manufacturers. Those sites and brands are outside our control. We are not responsible for their content, policies or practices. Links do not imply endorsement beyond what we expressly state.

6. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, regarding the Site’s accuracy, completeness, availability, fitness for a particular purpose or freedom from errors or harmful components.

To the fullest extent permitted by applicable law, Samanga Utilities Limited and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, data, goodwill or business opportunity, arising from your use of (or inability to use) the Site or reliance on its content.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under the laws of Uganda, including for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence where such exclusion is not permitted.

How we collect and use personal information in connection with the Site is described in our Privacy Policy. By using the Site you acknowledge that policy.

9. Changes

We may revise these Terms of Use from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Site after changes constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by the laws of the Republic of Uganda. Subject to any mandatory rights you may have, the courts of Kampala, Uganda shall have non-exclusive jurisdiction over disputes arising from these terms or your use of the Site.
